On Thursday, Pennsylvania Governor Josh Shapiro signed the Artificial Intelligence Deceptive Advertising Act into law. The measure requires that any advertisement “significantly modified or generated by artificial intelligence” carry a disclosure label presented in the same format as the ad itself.

The rule applies across formats, including still images, video, audio, and text. It covers advertisers of all sizes, from TV commercials produced by large companies to flyers created by small local businesses such as restaurants. According to the report, the labeling requirement applies regardless of where an ad appears.

Why it matters

Pennsylvania is described as one of the first states to mandate disclosures on AI-generated content, signaling growing state-level attention to transparency in advertising involving AI.

Who should care

Advertisers, marketers, and businesses of any size operating in Pennsylvania should note the new disclosure obligations for AI-generated or AI-modified ads.
